General Terms and Conditions of Reifenhotel 2000 GmbH
§1 Scope of Application and Definitions
1.1. These General Terms and Conditions (GTC) apply to all deliveries and services of
Reifenhotel 2000 GmbH, Hofherr-Schrantz-Gasse 2/1, 1210 Vienna, Austria
(hereinafter referred to as the “Seller”), which are carried out via the online shop,
in the version valid at the time of the order.
1.2. A consumer is any natural person for whom the transaction does not form part
of the operation of their business (§ 1 Austrian Consumer Protection Act – KSchG).
An entrepreneur is any natural or legal person or legally capable partnership
for whom the transaction forms part of the operation of their business.
§2 Contractual Partner

§3 Ordering Process
The ordering process comprises the following steps:
- Selection of the goods and adding them to the shopping cart.
- Clicking the “Checkout” button.
- Login, new registration, or ordering as a guest.
- Entering the billing and delivery address.
- Selection of the shipping and payment method.
- Review of the details and confirmation of the GTC and withdrawal policy.
- Completion of the order by clicking the “Order with obligation to pay” button.
§4 Offer and Conclusion of Contract
4.1. The presentation of products in the online shop does not constitute a legally
binding offer, but a non-binding online catalog.
4.2. By clicking the “Order with obligation to pay” button, the customer submits a
binding offer.
4.3. Confirmation of receipt of the order is sent immediately after submission via an
automated email (order confirmation). This does not yet constitute acceptance of the
contract.
4.4. The contract is concluded only when the seller accepts the offer within five
working days by written order confirmation or by dispatching the goods.
4.5. Special case – advance payment: When advance payment is selected, the contract is
concluded upon dispatch of the payment confirmation or receipt of payment.
§5 Correction of Input Errors / Storage
5.1. Input errors can be corrected before submitting the order using standard keyboard
and mouse functions as well as the “Edit” button.
5.2. The contract text is stored. The order details are sent to the customer by email.
For security reasons, the order data are no longer accessible via the internet after
completion of the order, but can be requested from customer service (subject to the
statutory retention periods under the UGB/BAO).
§6 Prices and Shipping Costs
6.1. The stated prices are final prices in euros and include statutory VAT.
6.2. Any applicable shipping costs are explicitly displayed in the shopping cart and on
the order page before completion of the order.
§7 Delivery
7.1. Delivery is made to Austria, Germany, and the countries listed in the shipping
overview.
7.2. Unless otherwise agreed, the delivery time to Austria and Germany is a maximum of
7 working days. In the case of advance payment, the period begins on the day after the
payment order is issued.
7.3. In the case of consumers, the transfer of risk generally occurs only upon delivery
of the goods to the consumer or a third party designated by them (§ 7b KSchG).
§8 Payment Terms
8.1. The customer may use the payment methods offered in the shop (e.g. advance payment,
PayPal, credit card, purchase on account).
8.2. Payment service providers: When paying via external service providers
(e.g. PayPal, Mollie, etc.), their additional terms of use apply.
8.3. In the event of default in payment, the seller is entitled to charge statutory
default interest (for consumers 4% p.a. pursuant to § 1000 ABGB; for entrepreneurs
9.2% above the base interest rate pursuant to § 456 UGB).
§9 Retention of Title
The goods remain the property of the seller until full payment of the purchase price.
§10 Warranty for Used Goods
10.1. The statutory provisions of the VGG and ABGB apply.
10.2. For used goods, the warranty period is 12 months from delivery of the goods. This
applies only if the reduction of the period was expressly agreed during the ordering
process.
10.3. Condition: Used goods (in particular rims and complete wheels) show signs of use
consistent with their age and mileage. Such wear-related signs (e.g. minor stone chips,
superficial scratches, or soiling) mentioned in the product description or visible in
the product photos do not constitute a defect. For more detailed product images, the
buyer must request these in writing.
10.4. For entrepreneurs, warranty claims for used goods are completely excluded.
§11 Right of Withdrawal
Consumers within the meaning of the KSchG have the right to withdraw from this contract within 14 days without stating reasons. The period begins on the day on which the consumer or a third party designated by them takes possession of the goods. (See separate withdrawal instructions for details.)
§12 Final Provisions
12.1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers with habitual residence in Austria, the mandatory provisions of Austrian law remain unaffected (principle of favorability pursuant to Art. 6 Rome I Regulation).
§13 Place of Jurisdiction
- If the customer is an entrepreneur, the registered office of the seller (Vienna, Austria) is the exclusive place of jurisdiction.
- If the customer is a consumer, they may bring claims against the seller before the competent court at their place of residence in Austria.
- The European Commission provides a platform for online dispute resolution (ODR) at https://ec.europa.eu/consumers/odr/ .
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Withdrawal Instructions
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, has taken possession of the goods.
To exercise your right of withdrawal, you must inform us:

by means of a clear statement (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send your notification of exercising the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for the additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notice of your withdrawal.
We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees for this reimbursement.
Right of retention: We may withhold the reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
Return of goods: You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired.
Costs of return:
- You bear the direct costs of returning the goods.
- For bulky goods such as complete wheels: The costs are estimated at approx. EUR 100–150 within Austria.
Compensation for loss of value: You only have to pay for any loss in value of the goods if this loss is due to handling of the goods that was not necessary to check their nature, characteristics, and functioning.
